These Terms of Service (“Terms”) govern your access to and use of the Travel Heist mobile applications, website at thetravelheist.com, and related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Travel Heist has zero tolerance for objectionable content or abusive users.Any user who posts content that violates Section 3 (Acceptable Use) or who harasses, threatens or abuses other users may have their content removed and their account suspended or permanently banned without prior notice. We review every report we receive and act on confirmed violations within 24 hours.
1. Eligibility
- You must be at least 18 years old to create an account or use the Service.
- You must have the legal capacity to enter into a binding contract in your jurisdiction.
- You must not be barred from using the Service under the laws of your country or any other country, including the country where you reside or from which you access the Service.
2. Your account
- You are responsible for all activity on your account. Keep your password secure.
- Provide accurate, current and complete information. You may not impersonate anyone else or misrepresent your identity, age or affiliation.
- One account per person. You may not transfer or sell your account.
- Notify us at support@travelheist.in immediately if you suspect unauthorized access.
3. Acceptable use
You agree that you will not:
- Create fake profiles, use someone else’s photos, or misrepresent your identity, age or gender.
- Harass, threaten, bully, stalk, dox or intimidate any user. Zero tolerance.
- Post or send sexual content involving minors; solicit, groom or meet minors; or any content that exploits a minor.
- Post hate speech, incitement to violence, terrorism or self-harm content.
- Post nudity, sexually explicit content, or content that violates another person’s privacy or dignity.
- Spam, scam, phish, run pyramid/MLM schemes, send unsolicited commercial messages, or operate bots.
- Scrape, crawl, reverse-engineer, decompile or attempt to derive source code, except to the extent allowed by law.
- Use the Service to violate any law, regulation or the rights of others, including intellectual-property rights.
- Upload malware, viruses, or interfere with the Service’s operation or security.
- Use the Service for commercial purposes without our written permission — for example, advertising, promotions, or recruiting for a competing service.
4. Your content
You own the content you post. By posting content (text, photos, videos, comments, messages, trip details, room listings, etc.) to the Service, you grant Travel Heist a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for example, resize images), create derivative works (such as previews and thumbnails), and display your content solely for the purpose of operating, promoting and improving the Service.
This license ends when you delete your content or your account, except (a) for content others have shared or saved before deletion, and (b) for reasonable backups that may persist for up to 90 days.
You represent that you own the content you post or have all rights necessary to grant this license, and that the content does not violate the rights of any third party or any law.
5. Our content
The Service itself — including our name, logos, software, design, branding and any content we create — is owned by Travel Heist and protected by copyright, trademark and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use.
6. Moderation, reporting & blocking
We actively moderate the Service to keep it safe. We may — and where appropriate, will — review, remove or restrict content that violates these Terms, our Community Guidelines or applicable law, and we may suspend or terminate accounts that engage in abusive behaviour.
Reporting. Every post, trip, room listing, comment and user profile in the app exposes a Report action. When you submit a report we acknowledge it in-app and our moderation team reviews it within 24 hours. Confirmed violations result in the offending content being removed and, where the violation is serious or repeated, the offending user being ejected from the platform.
Blocking. You can block any other user from their profile screen. Once blocked, that user can no longer contact you or appear in your feed, search results or recommendations, and their content is hidden from your view. Block is bidirectional and takes effect immediately.
How to contact our moderation team. In addition to the in-app Report button, you can email support@travelheist.in with the subject line “Report” and include the URL or screenshot of the offending content.
We are not responsible for content posted by users, but we commit to acting on violations brought to our attention as described above.
7. Suspension & termination
- We may suspend or terminate your account, or restrict your access, if you violate these Terms, create risk or legal exposure for us, or for any other reason at our reasonable discretion.
- We will usually give you notice and an opportunity to fix the issue, unless we believe delay would cause harm.
- You may terminate your account at any time by following the steps at /delete-account.
- Sections that by their nature should survive termination (including Content Ownership, Disclaimers, Liability, Dispute Resolution) will survive.
8. Meeting other users
Travel Heistconnects people who may meet in person. Always use good judgment: meet in public for the first time, tell a friend where you’re going, verify identities when you can, and do not share sensitive personal or financial information with strangers. We do not perform criminal background checks on users.
9. Third-party links & services
The Service may link to or integrate with third-party services (e.g. Google, Apple, Firebase). We are not responsible for the content, policies or practices of third parties.
10. Disclaimers
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement or course of dealing. We do not warrant that the Service will be uninterrupted, secure or error-free, or that any content posted by users is accurate or reliable.
11. Limitation of liability
To the maximum extent permitted by law, Travel Heist and its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, revenue, data, goodwill or other intangible losses, arising out of or relating to your use of the Service — even if we have been advised of the possibility.
Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you have paid us in the 12 months before the claim, or (b) USD 100.
12. Indemnification
You agree to indemnify and hold harmless Travel Heist from any claim, liability, damage or expense (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or any law or third-party right.
13. Changes to these Terms
We may update these Terms from time to time. If the changes are material, we’ll notify you in-app or by email at least 7 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
14. Governing law & disputes
These Terms are governed by the laws of India, without regard to its conflict-of-law rules. You agree to the exclusive jurisdiction of the competent courts located in India for any dispute, except where mandatory local law gives you the right to bring proceedings in your country of residence.
